Miami Short-Term Rental Compliance
Short-term rentals in Brickell and Downtown Miami are governed at three levels.
Miami-Dade County
- Miami-Dade & Florida Taxes — Short-term rental operators must comply with applicable Florida sales tax and Miami-Dade Convention & Tourist Tax requirements.
City of Miami
- STR-Eligible Building & Zoning — Short-term rentals of less than 30 days are considered a Lodging Use by the City of Miami and are only permitted where the property's zoning and approved building use allow lodging.
- Certificate of Use (CU) — An approved City of Miami Certificate of Use for Lodging is required to legally operate qualifying short-term rental units. The CU must be renewed annually.
- Florida DBPR Lodging License — Qualifying short-term rental operations must maintain the applicable Florida Department of Business & Professional Regulation lodging license.
- Business Tax Receipt — The applicable City of Miami Business Tax Receipt is required and must remain current.
- Operational Management Plan — The City requires an Operational Management Plan addressing items such as guest access, building operations, housekeeping, and a 24-hour responsible contact.
- Building & Fire Safety Compliance — Properties must comply with applicable fire and life-safety requirements, including smoke/CO detection, fire extinguishers, emergency exits, and building occupancy standards.
HOA / Building rules
- Condo Association Approval — The condominium declaration, association rules, and building operating policies must allow the intended short-term rental use. Many Brickell buildings impose minimum lease periods or prohibit transient rentals entirely.
- Certificate of Occupancy — The building must have the appropriate Certificate of Occupancy and comply with applicable Florida Building Code requirements for its approved use.
- Building-Specific Guest Rules — Registration procedures, parking or valet requirements, guest limits, amenity access, minimum stays, check-in procedures, and other rules vary significantly from one Brickell building to another.
