Orlando-Area Short-Term Rental Rules
Requirements differ by county — and sometimes by neighborhood or resort community — across the Orlando and Disney-area market.
Orange County
- **STR-Eligible Zoning** — Before purchasing or operating a vacation rental, owners should confirm that short-term rental use is permitted at the specific property address. Orange County maintains designated short-term rental zoning areas and overlays.
- **City of Orlando Is Different** — Traditional whole-home Airbnb rentals are generally not permitted in ordinary residential areas within the City of Orlando. Orlando's Home Sharing program generally requires the resident to live on-site and be present while guests stay. Whole-home transient rentals require appropriate commercial zoning and use approvals.
Osceola County
- **STR-Eligible Zoning** — Before purchasing or operating a vacation rental, owners should confirm that short-term rental use is permitted at the specific property address. Osceola County maintains designated short-term rental zoning areas and overlays.
- **Florida DBPR Vacation Rental License** — Qualifying vacation rental properties must obtain the applicable Florida Department of Business & Professional Regulation lodging license before operating.
- **Local Business Tax Receipt** — Properties in Osceola County generally require a Local Business Tax Receipt. Properties located within the City of Kissimmee may also require the applicable City business registration.
- **Osceola County Tourist Development Tax** — Short-term accommodations of less than six months in Osceola County are subject to a 6% Tourist Development Tax, in addition to applicable Florida taxes.
Polk County
- **Davenport / ChampionsGate Requirements** — Vacation rentals located in Polk County generally require the applicable DBPR license and a Polk County Local Business Tax Receipt for short-term rental activity.
- **Polk County Tourist Development Tax** — Short-term accommodations in Polk County are currently subject to a 5% Tourist Development Tax, in addition to applicable Florida taxes.
All Orlando–Disney Area Rentals
- **Florida Sales Tax** — Transient accommodations are subject to Florida's 6% state sales tax, plus applicable discretionary surtax and local tourist development taxes.
- **HOA & Resort Community Rules** — Many Disney-area vacation rentals are located inside resort communities. Individual HOAs may regulate minimum stays, guest registration, parking, occupancy, amenity access, trash procedures, pool use, commercial vehicles, and other operating requirements.
- **Property-Specific Verification Is Essential** — Two homes only a few miles apart can fall under completely different zoning, licensing, tax, and HOA requirements.
BestStay Florida helps owners verify STR eligibility and manage licensing, compliance, resort registration, revenue strategy, guest operations, cleaning, maintenance, and day-to-day vacation rental management throughout the Orlando–Disney area.
